停特偵辦案

不滿特偵組監聽國會,民進黨立委昨天傍晚在司法法制委員會提出,要求特偵組將現在偵辦、監聽的案子全部停止,結果意外通過,不過立法院想要架空特偵組,法務部長羅瑩雪今天直言,適法性有問題。

特偵組監聽國會風暴越演越烈,立法院司法委員會加倍奉還,決議特偵組應該立即暫停目前偵辦和監聽的所有案件。

“幾位特偵組的檢察官,儼然成為執政者的打手,所以我們認為這個時候,是不是讓一切回到正常司法運作的,模式和體系,就是廢掉特偵組” 

不過,形同”架空特偵組”的藍綠共識,法務部長羅瑩雪可是很保留。

“我覺得法律適法性有問題,因為特偵組是法律制定的,就是要設立的,那如果委員會的決議,可以改變的話,那我們設立制度的程序上面,都會混亂掉了”

藍營立委也承認,警告性的意味比較濃厚。

“是否有絕對的拘束力,就是還有待參考,但是呢,這也是讓法務部,一定要責成特偵組不能胡作非為,或是亂搞”

法界人士也多半認為,除非修改法院組織法及刑事訴訟法,不然立法院此決議對特偵組並無拘束力,特偵組可尊重決議,但無需照辦。

The leaking allegations against Prosecutor-General Huang Shih-ming have severely tarnished the reputation of the Special Investigation Division, the agency that Huang heads. There is also anger over the division’s wiretapping of a phone which is available for use by all lawmakers, a move that led a legislative committee today to call for stripping the division of its powers. 

The Special Investigation Division’s wiretapping of the Legislature has received censure from the lawmaking body’s Judicial Committee, which passed a motion ordering it to stop all ongoing investigations and all wiretapping cases.

A few prosecutors in this Special Investigation Division are simply thugs working for the administration, so we think at this time it may be best to go back to the normal functioning judiciary. In other words, get rid of the Special Investigation Division. 

The bipartisan consensus to strip the Special Investigative Division of its powers elicited a low-key response from new Justice Minister Lo Ying-shay.

I think there may be a legal issue because the Special Investigation Division was established by a law. If a resolution from the Legislature’s Judicial Commission can change this, then it will create a mess in our procedural system. 

Some pan-blue legislators believe that a strong warning may be enough.

Do they have absolute binding power or can they just advise? In any case, I think this does tell the Ministry of Justice that it cannot allow the Special Investigation Division to run amok.

Legal experts concur that it will take more than a resolution from the Legislature’s Judicial Committee to stop the Special Investigation Division. They say amendments would be needed to at least two laws.
