公平會創下全球首例,在耶誕節這天,宣布對蘋果亞洲公司開鍘!公平會歷經8個月調查,認定蘋果限制國內三大電信公司"綁約手機價格",違反公交法第18條,因此開罰新台幣2000萬。
如果要選購的智慧手機是蘋果iPhone,不難發現,無論中華電、台哥大、遠傳三家電信業者怎麼比,列出的「手機合約價」幾乎都一樣。
公平會今年4月立案調查,蒐證蘋果與電信業者間的電子郵件往來,認定蘋果限制電信業者"綁約手機價格",因此對亞洲蘋果公司,開罰台幣2000萬。

最主要是用公平交易法的第十八條,(事業體)它賣給對方,對方再去賣給第三者的話,事實上它就沒有自由定價的空間,那這地方就是所謂的不公平競爭裡面很大一個關鍵。
公平會認定,上游蘋果沒資格、也不該去管制下游的經銷商。誇張的是,就連「最低採購量」甚至「促銷廣告」,三大電信業者都必須經過蘋果同意。

蘋果公司確實就像大家了解的,好大的一個蘋果,搬都搬不動,公平會這次採取的一個動作,站在消費者角度,確實是應該給政府按一個讚。
就在歐盟也在調查蘋果限制轉售價格的同時,公平會搶先對蘋果祭鐵腕,也讓此案,有機會成為國際間的參考案例。亞太區蘋果公司則表示,須進一步了解後再對外回應。
Following an eight-month investigation, Taiwan’s Fair Trade Commission has decided to fine the Apple unit that oversees Taiwan sales NT$20 million. It is the first time the US consumer electronics giant has been penalized for the strict terms it imposes on telecom firms that resell its iPhone
There are many options for consumers interested in an iPhone, among them Chunghwa Telecom, Taiwan Mobile and Far Eastone. There’s no need to compare prices offered by these telecommunication operators because they’re virtually the same.
In April, the Fair Trade Commission began to investigate communication records between Apple and the telecoms. It decided that Apple wrongfully set limits on the price of cell phones tied to contracts. For this, the iPhone maker’s Asia subsidiary will be fined NT$20 million.

The key point is in Article 18 of the Fair Trade Act, says Lei Li-fen, the secretary-general of the Consumers’ Foundation. When an enterprise supplies a good to a trading counterpart for resale to a third party, the enterprise doesn’t have the right set a price. This is important for ending unfair competitive practices.
Based on this regulation, the Fair Trade Commission decided that Apple was not allowed to set a resale price. Other questionable practices include Apple’s minimum purchasing limits and control over advertisements.

Apple Inc. is as advertised: a big apple that is not easily pushed around, says Lei. This time the Fair Trade Commission is standing on the side of consumers. The government deserves credit.
The European Union is also investigating Apple’s iPhone sales tactics, and Taiwan’s Fair Trade Commission believes its ruling could serve as a reference for EU regulators. The Apple Asia unit plans to review the decision before giving a more detailed response.
