林益世輕判

正當各界質疑司法不公時，法界人士也拿出幾個案例對照，顯示出司法矛盾，其實，馬英九總統兩年前，也因為陳水扁二次金改無罪判決，罕見的發表意見，馬總統說：不能漠視部分法官做出違背人民期待的判決，如今綠營痛批，因為林益世是馬英九愛將，所以馬總統現在選擇漠視。

外界痛批法官輕判林益世一案，有律師舉出案例做強烈對比。

曾有男子幫朋友把風搶超商，僅獲得700元贓款，卻被法官判刑7年6個月。反觀林益世，收了上千萬喬合約，判決結果只涉及恐嚇取財判，並只判刑7年4個月，法界認為司法失去公平性。

而不得干涉及評論司法的馬英九總統，兩年前，可是為了陳水扁二次金改獲判無罪，冒著被批評的風險，也要對達體諒人民的憤怒。

對於扁案，馬總統有出來說話。但這回愛將涉貪輕判，外界反彈聲浪大，司法威信重創，馬總統則是沒任何回應，引發綠營批評。法務部長曾勇夫滅火，表示尊重檢方再提上訴，也透露案件來到高院二審，可能有不同見解。

Legal professionals consult precedents in Lin case (2013/05/02)

Alongside public discontent, legal professionals are making comparisons with precedents to show inconsistencies in former presidential aide Lin Yi-shih’s light sentence. As President Ma had previously sympathized with public anger over former President Chen’s innocent verdict two years ago, the DPP now criticizes his silence as the case involves one of his trusted aides. 

As public outcry over former presidential aide Lin Yi-shih mounts in intensity, many are making stark comparisons with legal precedents. 

Four years ago, a man in New Taipei City who assisted in the robbery of a convenience store made only NT$700, but was sentenced to seven years and six months. For Lin, however, receiving a bribe of millions and being convicted of extortion also received a comparable sentence. Those in the legal profession criticized the judiciary for this blatant injustice.

益世可拿錢

行政院前秘書長林益世收爐渣業者陳啟祥6300萬元，不僅因為輕判引起民怨，更讓民眾憤怒的是，法官認定，林益世只需要被沒收追繳沒收4880萬元，未來，他可以聲請發還1420萬元，各界一片譁然。

林益世獲知只被判七年四個月，臉上藏不住得意的笑容! 這判決讓許多人不解。

不僅如此，根據法院的判決，林益世收的6300萬贓款當中，只有包含在保險櫃中搜出的1580萬元不明所得，以及喬合約3300萬元賄賂加總的4880萬是需要沒收違法款項。換句話說林益世竟可以拿回1420萬元。

依照法院判決，林益世幫忙拿下合約所得不算濫用權力，因此所得之金額屬合法酬勞。民進黨立委許添財痛批法院背書公務人員受賄辦事。

Disgraced former Cabinet official can apply for return of NT$14 million (2013/05/02)

It seems that crime does pay. When former KMT Cabinet Secretary-General Lin Yi-shih was sentenced to just seven years and four months after extorting NT$63 million, many were shocked. Now it has emerged that the court considers a portion of these funds to be a legal service fee for assisting with contractual negotiations. Lin may be able to get back part of the money that was seized during the investigation. Lawmakers from across party lines ripped judges on Thursday for their line of reasoning. 

Lin Yi-shih couldn’t help but smile after learning he was sentenced to just seven years and four months. Most observers expected a harsher sentence.

Investigators had seized NT$63 million from Lin, an amount they say he extorted from the operator of a slag treatment center. But the court ruled that only NT$33 million of this sum was illegal gains. This amount will remain in the court’s possession, together with another NT$16 million or so of unaccounted wealth found in a safety deposit box. The remaining NT$14 million Lin is entitled to claim back from the court.

In essence, the court believes a portion of the “agreement” Lin reached with the slag center operator was a legal business deal. DPP Legislator Hsu Tain-tsair thinks that other constituents will expect services for pay.

The approach of summer means that cockroach season is on the way. Many people are disgusted by squishing the pests. Insecticides are an option, but they spread toxic gas. 

Japan has a solution. It has introduced an aerosol-based device that can freeze cockroaches by spraying a gas that is minus 75 degrees Celsius. The stunned roach can then be disposed of. For now, the device is only available in Japan.

幫丟垃圾罰

高雄市博惠里為了方便上班，先把垃圾堆放在巷口，等垃圾車一到，再由志工隊幫忙倒垃圾，想不到，這種互助丟垃圾的作法，被檢舉達人攝影檢舉，一個多月有二十四個人，被告發八十三件，其中一名七十四歲的郭先生，就被開了27張罰單。

74歲的郭先生，一次收到27張，每張開罰一千五百元的罰單，原來是他被檢舉達人拍到，沒等到垃圾車來才丟垃圾，而是把垃圾堆在巷子口，但鄰居幫忙做證說，大家都會互相幫忙丟垃圾。

Village residents fined for improper trash disposal (2013/05/03)

To help busy professionals, a village in Kaohsiung has an arrangement where residents leave their trash at the end of the street to be thrown away by volunteers. But an opportunist eager to earn commissions took photos of the residents and turned them in to the local government, resulting in 83 tickets for 24 people. 

Mr. Kuo, who is 74 years old, received 27 violation tickets at once. Each ticket is NT$1,500. This is because he was photographed leaving garbage on the street corner without waiting for the garbage truck to arrive. However, his neighbors confirmed that everyone in Po-hui Village helps each other throw out the trash.

The villagers feel that the government is being greedy.

雅妮換桿弟

前世界球后曾雅妮，今天起參加LPGA金斯米爾錦標賽，近況不佳的曾雅妮，找回前年與她一起奪下七個冠軍的桿弟傑森，希望能搶下睽違一年多的冠軍盃，今天的第一輪比賽，她以低於標準桿兩桿的69桿作收，暫時並列第19，和領先者相差5桿距離。

去年八月，陷入低潮的曾雅妮，不想讓出球后寶座，把合作了兩年多的桿弟Jason Hamilton換掉，取而代之的是風格較保守的Paul Fusco，但戰績不見起色，如今世界排名已經掉到第四的妮妮，決定把Jason Hamilton找回來。

Yani Tseng rehires old caddy (2013/05/03)

Taiwan’s Yani Tseng hopes another caddy switch will spark her struggling golf game. She has rehired Australian Jason Hamilton, a caddy she won 19 tournaments with. 

Tseng fired Hamilton last August after two years together. She hoped that bringing on the more reserved caddy Paul Fusco would break her out of her slump and let her keep her world number one ranking. The change didn’t help. After falling to four in the world, Tseng has decided to rehire Hamilton

Hamilton began serving as Tseng’s caddy in June 2010. They won 19 tournaments together, including seven in 2011. This was the year that Tseng took over the top ranking, a position she held for 109 weeks. The two got along well, and Hamilton was credited with helping Tseng’s game. She hopes his return provides another boost.

This week Tseng is taking part in the Kingsmill Championship, an event with a purse of US$1.3 million. In the first round she shot a 2-under 69, putting her in a tie for 19th place.

警戳遊行民

前兩天的五一勞工大遊行，警方用竹竿戳民眾的動作，引來外界批評執法過當。台北市議會上午要求警察局進行專案報告，當天負責中正一分局強調用竹竿是為了保護拒馬，也讓綠營議員砲聲隆隆，最後警察局長也認為不妥，表示將會檢討改進，並向全民道歉。

藍的、紅的、綠的，好幾根竹竿穿越拒馬，往抗議民眾裡頭戳，這是五一勞工大遊行當天，行政院前爆發的激烈衝突，綠營議員越看越火大。

Police express regret for heavy-handed approach against demonstrators (2013/05/03)

Taipei police have expressed regret after footage emerged of officers jabbing demonstrators with bamboo poles. The compunction comes after the police initially dismissed complaints by implying that protecting barricades is more important than the safety of demonstrators. 

Police jab blue, red and green bamboo poles at demonstrators on the opposite side of the barricade. These images are from in front of the Executive Yuan on International Workers’ Day on May 1. Pan-green city councilors say the police were out of line.

軍配偶中籍

以前有句口號「小心間諜就在你身邊」，現在立委發現，台灣有有70位涉及敏感資料的國軍官兵，包括16名軍官和54位士官，配偶是中國籍。綠營立委憂心，這些中國配偶可能遭到解放軍利用，竊取國家機密。

國防部每年舉辦「國軍集團婚禮」，鼓勵官兵成家、增產報國，不過綠委立委指出，有高達70位接觸或經手國軍敏感業務的弟兄，配偶是中國籍，其中以軍備局20人最多，最高層級是上校。

Defense Ministry refutes claim that cross-strait marriages put security at risk (2013/05/03)

DPP lawmakers say there are dozens of Taiwanese officers with access to sensitive information who are married to Chinese nationals. They worry about leaks, though the Ministry of National Defense says the lawmakers are exaggerating the issue and insist that sufficient security measures are in place. 

Each year the Ministry of National Defense holds a mass wedding to encourage marriage among those in its ranks. It believes that married soldiers can better serve the country, but some DPP lawmakers are concerned. They say 70 soldiers with access to sensitive information are married to Chinese nationals, including 20 in the Armaments Bureau and at least one colonel.

三恐龍法官

林益世被輕判7年4個月，三名承審法官成為眾矢之的！民進黨立委質疑，法官辦藍辦綠、兩套標準，法務部長曾勇夫也認為，這樣的判決結果，社會觀感不佳，而台灣國的王獻極，更趁著林益世到派出所報到時，直接嗆聲，要他教教A錢的技巧。

林益世一審被輕判7年4個月，引起社會譁然，他和妻子彭愛佳到派出所簽到時，遭到獨派人士嗆聲、諷刺。

林益世被嗆，三為負責審判的法官也被質疑，包括受命法官紀凱峰、陪審法官林孟皇、及審判長吳秋宏，其中吳秋宏去年還發起〝改革最高法院、拆除恐龍法官溫床〞的連署活動，現在卻成為綠營眼中的恐龍一族。

特偵組也認為，和議庭曲解法令見解，決定近日就會針對林益世的輕判，相關涉案人員無罪的結果，全面提起上訴。

The three judges who presided over the corruption trial of former Cabinet Secretary-General Lin Yi-shih have become a target of public scorn. DPP legislators question whether different standards are being applied to ruling and opposition party members. Justice Minister Tseng Yung-fu admits that the ruling has invited negative public opinion. 

The light sentencing of seven years and four months for Lin Yi-shih in the first trial caused public outcry. Lin was taunted by pan-green supporters when he reported with his wife Peng Ai-chia to the police station Friday.

While Lin is confronted with general scorn, the three judges at his first trial are also under public scrutiny.The trio includes commissioned judge Chi Kai-feng, associate justice Lin Meng-huang, and presiding judge Wu Chiu-hung.

Of these judges, Wu was involved last year in a petition to reform the Supreme Court to rid the justice system of so-called “dinosaur justices.” Now, Wu is regarded by the DPP camp as one of the dinosaurs.

The Special Investigations Division is also of the opinion that the court misinterpreted the law. As a result, it will appeal the verdict, which sentenced Lin lightly and let off all affiliated individuals.

嗆離島博弈

行政院昨天通過博弈專法草案，最快民國108年，台灣將有第一座國際度假村賭場在離島營運，不過條款規定相當嚴格，除了有年齡限制，如果配偶、或四等親申請禁止令，一樣不能進入賭場，立委就批評行政院管太多，可能會先嚇跑賭客和賭場業者。

不管是百家樂，還是吃角子老虎，未來台灣民眾不用出國，就可以在台灣合法賭博，第一座賭場將在離島馬祖營運，不過行政院的博弈法草案才剛出爐就被立委嫌。

“大家可能對(博弈產業)比較擔心，所以先從嚴，然後到時候再去檢討，是目前行政院的一個看法，不過這個看法到了立法院以後，恐怕各位委員跟我，都會有其他意見”

行政院版的博弈條款，其中最具爭議的就是，賭客的配偶或四等親以內的親友，甚至是具有同居一年以上事實的人，未來只要提出禁賭申請，賭客就無法進入賭場。

博弈專法草案已被列為立法院優先審議法案，交通部長葉匡時表示，若一切順利，最快民國108年國內首座合法賭場正式營業。

Lawmakers have begun reviewing Cabinet plans for a gaming act that would pave the way for casinos on outlying islands. Many issues still need to be worked out, including tax rates and measures for preventing gambling addiction. 

Baccarat, slot machines and other gambling games could soon become legal in Taiwan. There are plans to open the nation’s first casino on the outlying island of Matsu, and the Cabinet has sent a draft of related legislation to the Legislature. But first lawmakers need to approve the bill.

People might be worried about the casino industry, so we’re going to start strict. Later we can conduct a review. The version we have is from the Cabinet. But once it reaches the Legislature, lawmakers, including me, could have other ideas.

The most controversial part of the Cabinet’s draft is a clause that would let people apply to have close family members barred from entering casinos. Even non-relatives who have lived with a person for a year or more could request the ban.

民進黨立委陳亭妃，抨擊許多教育部官員卸任後，轉到私校任職，官員除了能坐領月退俸及該校的薪水，有些私校還能得到教育部的補助，儼然是私校門神。被點名的中國醫藥大學校長黃榮村，不甘受辱，隨即發表請辭聲明。今天上午，他回應，說學校獲補助，是經過長期努力的成果!

University president resigns in anger over accusations (2013/05/03)

DPP Legislator Chen Ting-fei criticized retired Ministry of Education employees who become re-employed in private educational institutions. Many of these retirees serve as “guardian angels” of private schools, receiving both a salary and pension while helping the schools obtain government subsidies. China Medical University President Huang Jong-tsun, who was directly named, felt insulted and tendered his resignation in anger.

In terms of education, research and international reputation, the China Medical University has seen obvious improvements in the last few years. To say that the fruits of its efforts are due to the influence of one or two people is already inappropriate. To further claim that this is because of hiring guardian angels – I don’t think anyone can accept this kind of opinion. 

Huang served as minister of education when the DPP was in office. He decided to tender his resignation because this is not the first time he has been criticized for his role at the university or for earning two salaries. DPP Legislator Cheng Ting-fei, who had voiced such criticism, expressed regret.

Smokers may get fewer hours of sleep and have less restful slumber than non-smokers, according to a German study that looked at more than two thousand people.

根據德國一項觀察2000多人的研究，吸菸者睡眠時數可能比不吸菸者少，也較容易淺眠。

Researchers whose work appeared in the journal Addiction Biology found that of nearly 1,100 smokers surveyed, 17 percent got fewer than six hours of sleep each night and 28 percent reported "disturbed" sleep quality.

成果刊登在「成癮生物學」期刊的研究人員發現，在他們調查的近1100名吸菸者中，17%每天晚上睡不到6小時，28%表示睡眠品質「受到干擾」。

That compared with rates of seven percent and 19 percent respectively among more than 1,200 non-smokers who were also surveyed, said lead researcher Stefan Cohrs, of Charite Berlin medical school in Germany.

德國柏林夏里特大學醫學院的研究計畫主持人寇爾斯說，調查的1200多名非吸菸者中，睡不到6小時與睡眠品質受到干擾的比例，分別是7%與19%。

The findings cannot prove that smoking directly impairs sleep, since smokers may have other habits that could affect their shut-eye such as staying up late to watch TV or getting little exercise.

A Texas company could have the answer to some consumers’ unwelcome discovery that just-purchased loaves contain mold.

麵包剛買就發霉，讓消費者不開心，一家德州公司或許有辦法解決。

MicroZap Inc. claims its technology allows bread to stay mold-free for 60 days. The bread is bombarded with microwaves for about 10 seconds, which kills the mold spores, said chief executive officer Don Stull said.

MicroZap公司聲稱握有技術可讓麵包60天不發霉。執行長斯特表示，麵包經過微波10秒後，就能殺光黴菌孢子。

The process could eliminate bakers’ need for preservatives and ingredients used to mask preservatives’ flavor, as well as reduce food waste and increase bread’s shelf life, he said.

斯特表示，這個過程或許可以讓麵包師傅不再需要防腐劑，或使用其他材料來掩蓋防腐劑的味道，也能減少食物浪費，延長麵包的保存期限。

Researchers at Texas Tech University also see using the technology in bread made in developing countries, where there are fewer food safety standards and spoilage is a problem.

After 60 days, researchers found the treated bread that remained packaged had the same mold content when compared to a freshly baked loaf, Stull said. In the end, though, he knows it comes down to consumers’ palates.

The reptile had been sunning itself on a rock in a national park in the Northern Territory but then seemed to want to cool off.

The animal launched itself directly at Swedish tourist Felix Andersson, hitting him in the face before landing in the water.

Mr Andersson and his friend Ulrik Bergsland quickly swam away laughing and were not hurt in the incident.

In fact the pair were so unfazed they carried on swimming in the lagoon.

Clean and green Singapore is going even greener this Chinese New Year, recycling S$2 bills for red packets of money alongside the printing of new ones.

乾淨環保的新加坡今年中國新年將更環保，因其印新鈔同時，也循環再使用2元紙鈔，做為壓歲錢之用。

Giving out the little packets, or "lai see", with crisp new notes during the Lunar New Year is a long-standing tradition. Adults typically give them to children, older relatives and unmarried siblings to wish them good luck for the coming year.

在農曆新年期間，給出裝有新印鈔票的小袋，或稱「來喜」，是長久以來的傳統。大人通常將它們送給孩子、年長親戚以及未婚手足，希望他們來年好運。

As well as printing millions of brand new $2 notes as it has done in the past, the Monetary Authority of Singapore （MAS）, the wealthy Southeast Asian city-state’s central bank, said it will issue older notes that look as good as new and encourage the public to use them.

US researchers found patients with gout who ate cherries over a two-day period had a 35% lower risk of attacks compared to those who did not. The study in Arthritis & Rheumatism said cherries contain anthocyanins, antioxidants which contain anti-inflammatory properties.

Gout is a common type of arthritis that can cause sudden and very severe attacks of pain and swelling in the joints, particularly in the feet. Gout affects about one in 100 people, with men two to three times more likely to be affected than women.

In this study, researchers from Boston University recruited 633 gout patients with an average age of 54. Most were male. People were asked to record gout attacks including symptoms, the drugs they used and their diet and drinking patterns in the two days prior to the attack, including whether or not they had eaten cherries or cherry extract intake.

A Bangladeshi court ruled on Monday that a lovesick macaw parrot be reunited with her male partner after she stopped eating in the wake of their separation.

A woman has given birth to a 7lb baby boy in a helicopter taking her to hospital from her home on the northernmost Shetland island of Unst.

Shetland Coastguard received a call from her doctor at 4.30am, asking about ferry times from the island to the hospital in Lerwick, capital of the island chain.

People born during the summer are less likely to be CEOs, according to a new study from the University of British Columbia.

The study investigated the birth month of 375 Chief Executive Officers from S&P 500 companies and found a significantly lower amount of CEOs were born in June and July compared to other months.

June babies accounted for six per cent of CEOs, while July babies made up only five per cent.
